General Terms and Conditions and Consumer Information of the Company HAINSER GmbH
I. General terms and conditions
The contract between the company Hainser GmbH, Eichborndamm 167 G55, 13403 Berlin, hereinafter referred to as the Seller, and the Buyer is concluded only on the basis of these General Terms and Conditions. All other general terms and conditions are not recognized and apply only if they have been accepted in writing by the seller.
Consumer is any natural person who enters into a legal transaction for a purpose that can be attributed neither to his commercial nor his independent professional activity. An entrepreneur is any natural or legal person or partnership with legal capacity who, when concluding the contract, acts in the exercise of his commercial or independent professional activity.
II. processing of the order and conclusion of the contract
The Seller operates an online store on the website www.hainser.de, which offers various goods for purchase by the Buyer.
For the purchase a special registration by the buyer is not necessary. For the order processing is required to provide the address and all other data and information necessary for the proper execution of the contract. This data is stored by the seller and can be viewed and changed by the buyer at his request. The data is entered by using the usual keyboard and mouse functions in the appropriate input fields on the website www.hainser.de and its subpages.
The ordering process is initiated by selecting the products from the Seller's offer and placing them in the Buyer's shopping list by clicking the "add to cart" button. After that, the Buyer determines the number of products to be purchased, the shipping method and the payment methods. After entering the required information, the Buyer proceeds to the input mask for personal information about the Buyer and the delivery address by clicking the button "continue to checkout". After selecting the "continue" option, the selection box with payment options appears. After selecting the option suitable for him, the transition is made by means of the button "continue" to the subpage on which all the order information is listed again.
By clicking the button "order with obligation to pay" the buyer makes a binding offer to purchase the goods in the shopping cart. Before sending the order, the buyer can view his data again and correct it if necessary.
The submission of the order requires clicking the button "I have read the terms and conditions of the provider and declare my agreement by sending the order. I have taken note of the cancellation policy".
After sending the order, the buyer is sent an automatic confirmation of receipt by e-mail, which contains all data on the submitted order. It can be printed out by the buyer using the usual print functions. It is expressly pointed out that this confirmation of receipt does not constitute a declaration of acceptance by the Buyer and merely serves to confirm receipt of the order by the Seller. The effective declaration of acceptance is made by sending the order confirmation to the buyer in a separate mail. The Seller has the right to accept the Buyer's order within 2 days after its receipt by sending the order confirmation by mail.
Consumers can revoke their offer declarations in accordance with the revocation policy, which is communicated to i on the website www.hainser.de and return the ordered goods.

III.availability of goods
All offers of the seller are non-binding. If the product ordered by the buyer is not available, the buyer will be informed immediately in the order confirmation and refrain from the declaration of acceptance, so that no contract is concluded.
IV. Retention of title
The seller retains ownership of the goods until full payment of the purchase price (including VAT and shipping costs).
The Buyer may not resell the goods delivered by us and subject to retention of title without our prior written consent and already now assigns to the Seller the claims arising from the resale in the event of a possible resale. The Buyer shall be authorized to collect the claims thus assigned in the ordinary course of business, whereby this authorization may be revoked at any time in the event of default in payment by the Buyer.
V. Contract execution and shipping costs
The purchase price is always paid in advance. The ordered products will then be shipped to the buyer after the purchase price has been credited to the seller's bank account. If other payment methods are offered, then they are indicated in the respective product description.
The price of the offered goods also includes VAT at the currently applicable rate. The shipping costs are indicated in the respective item description and are to be borne by the buyer. Should the buyer, who is a consumer, make use of his legal right of withdrawal, then the shipping costs will be reimbursed to him. The buyer must then bear the direct return costs.
The delivery time is up to 5 days. The period for delivery begins with payment in advance on the day after issuing the payment order to the remitting credit institution or, in the case of other payment methods, on the day after conclusion of the contract to run and ends with the expiry of the last day of the period. If the last day of the period falls on a Saturday, Sunday or a public holiday recognized by the state at the place of delivery, the next working day shall take the place of such a day.
